Terms and Conditions of Sale
Registration for services provided by SURF CENTER implies the subscriber’s full and unconditional acceptance of these terms and conditions, and the subscriber agrees to inform each participant of all the terms and conditions.
I. Rental Services
Art. 1 – Parties
SURF CENTER offers self-guided rentals of watercraft—canoes, pedal boats, windsurf boards, electric boats, and catamarans—in natural settings. None of the activities offered are supervised or insured by guides; however, instructions on how to use each piece of equipment are provided before the activity begins.
Art. 2 – Registration and Reservations
All our activities require a reservation. To make a reservation, you have several options: fill out the online reservation form (www.surfcenter.fr), contact SURF CENTER directly by email ([email protected]), or visit the reception desk at our base in Les Salles-sur-Verdon.
EXCURSIONS: Registration is confirmed once the registrant receives an email or text message confirming the reservation for the selected excursion.
The balance must be paid directly to the instructor in their own name on the day of the reservation.
Art. 3 – Prices
SURF CENTER’s rates are listed on the website and in the activities catalog available at the front desk.
Please refer to the product specifications, available on our website or upon request.
Prices do not include: any equipment rentals (e.g., GoPro), transportation to the activity location (meeting point and activity site), and personal expenses.
For day trips, meals (picnic, water, snacks) are the customer’s responsibility.
Art. 4 – Payment Methods
Accepted payment methods: check, vacation vouchers, bank transfer, credit card (secure online payment), or cash.
Art. 5 – Conditions of Participation
For the rental of sports equipment, the customer acknowledges having sufficient knowledge and technical skills to practice this sport independently.
In this case, the customer participates in the activity for which the equipment is rented under their own full responsibility and at their own risk. SURF CENTER cannot be held liable for any accidents that may occur during this unsupervised activity.
Since the SURF CENTER team and the SURF CENTER SASU do not have the means to verify the sporting proficiency of its customers, it is therefore up to each participant/customer to assess their physical fitness, knowledge, and skills in light of what they wish to accomplish. Our activities are open to everyone; however, certain conditions must be taken into account (age restrictions, ability to swim, technical skill level, physical fitness, etc.).
It is therefore the responsibility of each participant to assess their physical fitness based on the water sports equipment they wish to rent. To learn about these conditions, please refer to the technical descriptions of the courses (available on our website www.surfcenter.fr).
You must not have any medical contraindications to participating in the chosen activity.
IMPORTANT: If you have no medical contraindications but require special medical care or treatment (asthma, diabetes, etc.) or if your health condition requires special attention (fragile joints, back problems, mandatory use of glasses, etc.), you must bring the appropriate emergency medications as prescribed by your doctor.
Art. 6 – Insurance and Liability
SASU SURF CENTER is covered by civil liability insurance for all the activities it offers and cannot be held liable for activities booked through other service providers.
In the event of a personal injury on one of our vessels, SASU SURF CENTER is released from liability once the victim is taken into the care of the appropriate emergency services, and any subsequent hospital treatment will be the responsibility of the injured person’s personal insurance.
The participant/customer is responsible for the equipment loaned to them for the activity. The provider cannot be held liable for any damage caused by the equipment provided.
In the event of theft or damage to the loaned equipment, the participant/customer may be required to pay compensation for wear and tear or to reimburse the full cost of the equipment.
SASU SURF CENTER cannot be held liable for the loss, theft (including from vehicles), or breakage of personal items (e.g., sunglasses, cameras, etc.) that participants may bring with them during the activity and that may occur during the activity.
Art. 7 – Cancellation / Interruption by the Customer
7.1 Cancellation by the customer
Cancellation of a reservation: Given the high volume of tourists, the balance will be due.
In cases of force majeure and upon presentation of supporting documentation, SURF CENTER may refund the amount paid, but cannot be compelled to do so by the customer. In all cases, the customer agrees to notify SURF CENTER of any changes regarding the reservation.
7.2 – Interruption During the Service
In the event of an interruption during the service, the customer or participant shall not be entitled to any refund.
Art. 8 – Cancellation / Exclusion by the Company
8.1 – Cancellation
SURF CENTER reserves the right to cancel or modify the outing depending on weather conditions.
The activity may be canceled for safety reasons (weather, EDF water releases, flooding, etc.) or due to any other force majeure event. In this case, a replacement activity will be organized whenever possible, or an alternative date will be offered. If the outing cannot take place, the service fee will be fully refunded, and no further compensation will be provided.
8.2 – Exclusion
SURF CENTER instructors reserve the right to exclude any participant who is intoxicated or whose behavior is likely to disrupt the smooth running of the activity or compromise the safety of the group. In such cases, the customer or participant will not be entitled to any refund or compensation.
Art. 9 – Appointments
A meeting time and location are always provided to you, regardless of the service. To ensure the smooth running of activities, please review the itineraries and other instructions we have sent you in advance. Please plan your travel time so that you arrive on time. We allow for a maximum delay of 15 minutes. Beyond this time limit, the duration of the activity will be shortened.
Art. 10 – Youth (Minors)
Unaccompanied minors:
Minors under the age of 14 who are not accompanied by an adult (legal guardian) are not permitted to participate in so-called “group” activities.
Minors between the ages of 14 and 18 who are unaccompanied may be admitted to activities, provided they are under parental supervision.
Art. 11 – Gift Certificate
The gift certificate becomes valid upon receipt of the full amount for the service.
The gift certificate is non-transferable. However, it may be transferred to a person of your choice provided you notify us in advance to update the new recipient’s information.
The gift certificate recipient must contact us to book the activity.
The activity listed on the gift certificate may be exchanged for another activity offered by SURF CENTER, provided that the value of the new activity is less than or equal to that of the activity listed on the gift certificate. However, it is possible to participate in an activity with a higher price by paying the difference.
PLEASE NOTE: The gift certificate has an expiration date. Once the validity period (the current year) has passed, the service will be considered fulfilled and cannot be rescheduled. Neither the recipient nor the purchaser will be entitled to any refund or compensation.
The gift certificate and the document bearing the recipient’s name must be presented on the day of the outing at SURF CENTER.
Art. 12 – Dispute Resolution
The parties shall endeavor to resolve amicably any difficulties that may arise in the performance of the contract. If no amicable agreement can be reached, all disputes relating to the validity, interpretation, and performance of this agreement shall be governed exclusively by the laws of France.
All disputes, of whatever nature, shall fall within the jurisdiction of the French civil and commercial courts, including those ruling on interim relief.
